TERMS AND CONDITIONS

OVERVIEW

This website is operated by DB Studio. Throughout the site, the terms "we," “us,” and “our” refer to DB Studio.

By engaging with us through our website or any other platform, you agree to the terms and conditions (“Terms of Service,” “Terms,” “Ts & Cs”), outlined below. These conditions apply to all furniture orders, custom pieces, kitchen, bedroom or bathroom cabinets, and any other service provided by DB Studio. These Ts & Cs apply to all users of the site, including browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Ts & Cs carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Ts & Cs. If you do not agree to all the terms, you may not access the website or use any services. These terms govern all purchases from DB Studio and are divided into two main categories: General Furniture and Kitchens and Cabinetry.

Acceptance of Terms and Conditions:

Making a payment signifies your acknowledgment, understanding, and acceptance of these terms. Please read these terms carefully before proceeding with any payment. If you have any questions, feel free to inquire before making a purchase.

Section 1: Kitchens and Cabinetry

1. Quotation:

All kitchen and cabinetry quotes are valid for 15 days from the date of issue. After this period, pricing and lead times may change due to material cost fluctuations. An order will only be processed upon receipt of a signed approval of the sales order, which will serve as acceptance of these terms and conditions. If any part of the quote is not accepted, we may amend the quote and any associated guarantees before starting the work. A detailed sketch or design concept, where applicable, will be provided to the client, outlining the agreed style, dimensions, and specifications.

2. Order Changes:

Once the kitchen or cabinetry layout is approved, we will order materials. Any subsequent changes may result in additional costs, including but not limited to material reordering, additional labor, or administrative fees. Please review the layout carefully to minimize additional charges. All order amendments must be communicated in writing. Clients are allowed two rounds of changes to the design at no extra cost. Beyond this, a design fee of 5% of the total project cost will be applicable.

3. Lead Time for Orders and Manufacturing:

Lead times for kitchens and cabinetry typically range from 8-12 weeks, depending on the size and complexity of the project. Custom kitchens may take up to 16 weeks. Lead time starts only after the layout is approved, not upon deposit payment.

4. Material Availability and Pricing:

The cost and availability of materials at the time of the quote determine the pricing. If materials become unavailable, alternative options will be offered, which may affect pricing and lead time.

5. Installation, Site Preparation, and Access:

The customer must ensure the site is prepared and accessible on the scheduled installation day. Delays due to unprepared sites or restricted access may incur additional fees. DB Studio is not responsible for any damage resulting from installation if the site is not properly cleared or prepared.

6. Delivery and Installation:

Charges may apply for complex site conditions, such as restricted access to estates or apartment buildings. The risk of damage is transferred to the customer upon delivery. Clients must inspect items upon delivery and notify us immediately of any defects. DB Studio is not liable for any damage or loss caused during transportation by third-party delivery services unless such services were contracted directly by us. The client is responsible for ensuring the products fit within their intended spaces, including delivery paths. DB Studio will not refund or accept returns for items that do not fit.

7. Plumbing and Electrical Services:

We do not directly provide plumbing or electrical services, as we are not licensed plumbers or electricians. However, we maintain trusted relationships with skilled professionals in these fields. If required, we can coordinate and manage these services as part of the overall project, ensuring that all utilities are properly installed and aligned before cabinetry installation. This project management service can help streamline the process and ensure quality control. Please note, if utilities are improperly placed by a third party and we need to return to the site to address these issues, additional charges will apply. For any project management of plumbing and electrical services, costs will be outlined and agreed upon beforehand.

8. Custom Cabinets and Design Modifications:

Actual sizes and designs may vary slightly due to material limitations or design enhancements. Any modifications will aim to enhance product quality, and customers will be notified of significant changes.

9. Payment Terms:

For all cabinetry projects, a 60% deposit is required before work commences. An additional 30% payment is due upon completion of manufacturing. The remaining 10% balance is payable upon receipt of the final invoice after project completion.

10. Cancellation Policy:

Custom kitchens and cabinetry orders cannot be canceled after the 7th day of order placement. Cancellation within 2 days incurs a 25% fee, and 50% within the 3rd to 7th day. Orders after 7 days are non-cancellable due to the custom nature of the products.

11. Warranty and Guarantee:

We offer a 5-year workmanship guarantee on all cabinetry work. This guarantee is void if accounts are not settled in full within 30 days of the payment due date. The warranty does not cover water damage, misuse, or overloading of cabinets. Any modifications to the cabinets after installation void the guarantee.

Section 2: General Woodwork / Furniture

1. Quotation:

Quotations are valid for 30 days from the date of issue. After this period, prices are subject to change without prior notice. Discounts only apply during the specified period.

All order amendments must be communicated in writing. Changes are effective only after confirmation. Changes requested after layout approval may incur additional costs, such as reordering materials or additional labor charges. Clients are allowed two rounds of changes to the design at no extra cost. Beyond this, a design fee of 5% of the total project cost will be applicable.

3. Lead Time for Orders:

Our standard production lead time is 6-8 weeks from receipt of the deposit, depending on the complexity of the order and the current workload. Custom projects may take up to 12 weeks. This timeframe may be adjusted based on external factors, such as material availability, but clients will be notified of any delays. If a client requires an expedited order, a rush fee may apply, and deadlines will be subject to production capacity.

4. Materials and Pricing:

All pricing is based on the availability and current cost of materials at the time of quoting. Any changes in material availability or cost will be communicated, and alternate options will be provided, which may affect pricing and lead times.

5. Product Design and Size:

Slight variations in size or design may occur due to material availability or manufacturing constraints. We reserve the right to make design changes to improve product quality. Customers will be informed of any significant changes.

6. Terms of Payment:

A 60% deposit is required for orders over R15,000. Orders below this amount must be paid in full before commencing. The balance is due upon completion of manufacturing. All goods remain the property of DB Studio until full payment has been received. Failure to settle the balance within 30 days of the invoice date will result in a monthly 10% storage fee. If the balance remains unpaid for more than 60 days, we reserve the right to sell the item to recover costs.

7. Cancellation Policy:

Cancellation within 2 days of order placement incurs a 25% fee. After 7 days, cancellations are no longer accepted. Since we manufacture custom products, once production begins, orders cannot be cancelled.

8. Delivery and Collection

Delivery fees are not included in the quotation unless specified. Delivery charges will be quoted based on location and complexity. Delivery times will be arranged in advance. It is the client’s responsibility to ensure accessibility to the delivery location, including doorways, staircases, and passageways. If the product does not fit, additional modifications and delivery attempts will incur extra charges. Upon delivery, the client or their representative must inspect the product for any damage. Any issues must be reported immediately before signing the delivery receipt. Once the item has been delivered and accepted, DB Studio cannot be held responsible for any damage unless a manufacturing fault is reported within 5 days of delivery. If the client cannot accept the delivery within the agreed timeframe, a storage fee may apply.

9. Workmanship Guarantee:

We provide a 12-month workmanship guarantee on all our furniture products. This guarantee is void if the account is not paid in full within 30 days of the due date. This warranty covers issues related to craftsmanship and material defects. It does not cover normal wear and tear, misuse, or damage caused by improper care. Any modifications, misuse, or neglect of care instructions will void the warranty.

10. Product Care and Maintenance

DB Studio’s products are crafted from natural wood and other materials that may change over time. It is important to care for the items as outlined below:

  • Indoor furniture: Clean with appropriate furniture care products and avoid exposure to direct sunlight or moisture.
  • Outdoor furniture: Must be regularly treated with protective oil or sealer to ensure longevity.
  • Avoid placing hot items directly on wooden surfaces, as this may cause damage.

11. Wood Choices

Natural wood is subject to variations in grain, color, and texture. These natural characteristics are not considered defects. Certain types of wood may develop small cracks or dents over time due to their natural properties. Clients are advised to consider the durability of the chosen wood when making their selection.

12. General Terms and Conditions:

Storage Fees: If customers cannot collect or receive their order on the agreed date, we offer 14 days of free storage. Beyond that, we will charge R100 per item per day for up to 3 months. Uncollected items after this period may be sold to recover storage costs.

Product Liability: We use SABS-approved materials, but we are not liable for damages due to unforeseen circumstances such as delamination, water damage, or discoloration. Please refer to the manufacturer warranties where applicable.

Force Majeure: DB Studio is not liable for any delays or failure to fulfill orders caused by events beyond our control, including but not limited to natural disasters, strikes, or supply chain disruptions.

Intellectual Property: All designs and products are the intellectual property of DB Studio. Reproduction of designs without our express permission is prohibited.

Governing Law: These Ts & Cs shall be governed by and construed by the laws of South Africa. Any disputes arising from the use of this service will be settled under South African jurisdiction.

By proceeding with an order from DB Studio, you agree to these terms and conditions. Please contact us for any further clarifications or questions at hello@dbstudio.co.za
